Please read these Terms and Conditions ("Terms") carefully before using Mixer.fund ("Mixer", "we", "us", "the platform"). By accessing or using Mixer, you agree to be bound by these Terms. If you do not agree, do not use the platform.
01Description of Service
Mixer is a social index platform on Solana that allows users to create, invest in, and share diversified on-chain portfolios ("Mixers") composed of tokenized assets. Mixer is currently in active development, including running on Solana devnet, and features may change, break, or be removed without notice.
02Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use Mixer. You are responsible for ensuring your use of the platform complies with the laws of your jurisdiction, including any restrictions on cryptocurrency or digital asset trading.
03No Financial Advice
Nothing on Mixer constitutes financial, investment, legal, or tax advice. Mixers, allocations, and creator content are user-generated and reflect the opinions of their creators, not recommendations from Mixer. You are solely responsible for your own investment decisions.
04Risks
Use of Mixer involves significant risk, including but not limited to:
- Volatility and potential total loss of value of digital assets
- Smart contract bugs, exploits, or failures
- Network congestion, downtime, or failure of the Solana blockchain
- Loss of funds due to user error (e.g., lost private keys, incorrect transactions)
- Regulatory or legal changes affecting digital assets
You acknowledge and accept these risks. Mixer is not responsible for any losses arising from your use of the platform.
05Wallets and Custody
Mixer does not custody your funds or private keys. You are solely responsible for securing your wallet, private keys, and seed phrases. We cannot recover lost keys or reverse blockchain transactions.
06User Content and Conduct
By creating a Mixer, posting content, or otherwise using the platform, you agree not to:
- Upload unlawful, infringing, fraudulent, or misleading content
- Attempt to manipulate markets, prices, or platform mechanics
- Interfere with or disrupt the platform's operation or security
- Impersonate any person or entity
We reserve the right to remove content or suspend accounts that violate these Terms.
07Fees
Mixer may charge trade fees and creator fees as disclosed within the platform. Fee structures may change over time; current rates are shown in-app at the time of a transaction.
08Intellectual Property
The Mixer name, logo, and platform design are the property of Mixer and its creators. Content you create (e.g., a Mixer's composition and description) remains yours, but you grant Mixer a license to display it on the platform.
09Disclaimer of Warranties
Mixer is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10Limitation of Liability
To the maximum extent permitted by law, Mixer and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or assets, arising from your use of the platform.
11Changes to the Service and Terms
We may modify, suspend, or discontinue the platform, or update these Terms, at any time. Continued use of Mixer after changes constitutes acceptance of the revised Terms.
12Termination
We may suspend or terminate your access to Mixer at any time, for any reason, including violation of these Terms.
13Governing Law
These Terms are governed by applicable law in the jurisdiction in which Mixer operates, without regard to conflict-of-law principles.
